The Raffle is open to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age. To enter, eligible entrants must purchase one or more raffle tickets for the Raffle. Tickets for the Raffle cost fifty dollars ($50.00) each. Tickets must be purchased prior to the drawing and while supplies last. Raffle winners will be drawn on May 21, 2017. Employees of Popejoy Hall (UNM Public Events) (“Administrator”), its agencies, its contracted partners, and members of their immediate families are ineligible to participate or win. Void where prohibited. All raffle tickets must be purchased or issued in New Mexico or other authorized jurisdiction. Participation constitutes each entrant’s full and unconditional agreement to these Official Rules and the decisions of the Administrator, which are final and binding in all matters related to the Raffle. Winning the Raffle is contingent upon fulfilling all requirements set forth herein. The Raffle consists of a random winner drawing.
The Raffle begins on October 4, 2016 at 12:01 am Mountain Time (“MT”) and ends on May 21, 2017 at or about 9:00 pm MT (the “Raffle Period”).
HOW TO ENTER
To participate in the Raffle, you must purchase one (1) or more raffle tickets during the Raffle Period. Raffle tickets are fifty U.S. dollars ($50) each. Winner need not be present at the drawing to win.
VERIFICATION OF WINNER
All potential winners are subject to verification by the Administrator, whose decisions are final and binding in all matters related to the Raffle. An entrant is not a winner, unless and until entrant’s eligibility has been verified and entrant has been notified that verification is complete. Administrator will not accept photographs or other evidence of winning in lieu of its validation process. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning are contingent upon fulfilling all requirements. The potential winner will be notified by mail, email, or phone. Each potential prize winner will be required to sign and return an Affidavit of Eligibility, Liability and Publicity Release (“Affidavit”) (except where prohibited), which must be received by Administrator within thirty (30) days of the date notice or attempted notice is sent, in order to claim his/her prize. If a potential winner of the prize cannot be contacted, fails to sign and return the Affidavit within the required time period (if applicable), or prize is returned as undeliverable, such potential winner forfeits the prize. In the event the prizewinner is disqualified for any reason, Administrator will award the prize to an alternate winner by random drawing among all remaining eligible entries. Winner must present raffle ticket stub when asked to prove eligibility.
Grand prize is a trip for two (2) to Las Vegas, Nevada consisting of the following: (i) round-trip, coach or economy class airfare from Albuquerque, New Mexico, U.S.A.; (ii) hotel accommodations in one (1) double-occupancy room (room rate and tax only) for five (5) nights on the Las Vegas Strip; (iii) two (2) tickets to three Las Vegas shows of winner’s choosing.
The trip must be completed by June 30, 2018, or prizewinner forfeits the prize in its entirety. Administrator must be notified of travel dates forty-five (45) days before the first date of travel. Administrator reserves the right to select the airline and flight times, ground transportation options, hotel accommodations, and Broadway performances.
The prize may be picked up from the Popejoy Hall administrative office at a mutually agreed-upon time and date. In the event that the prize or certificate is mailed to the winner, it will be with prior written consent of the winner and therefore, winner assumes the risk of its arrival. Popejoy Hall and the University of New Mexico are not responsible for the safe arrival of a prize or certificate. The prize is not transferable.
Approximate Retail Value (“ARV”) of the grand prize package: $7,000. Actual value may vary based on airfare fluctuations. Winner will not receive the difference between the actual value and the ARV. Total value of the trip is not to exceed $7,000. Odds of winning the prize depends on the number of raffle tickets sold during the Raffle Period. No more than 5,000 raffle tickets will be sold.
Second prize is two (2) tickets to opening night of every show in the 2017-2018 Popejoy Presents season. Tickets to be assigned in ‘A’ price seating and will be assigned by Popejoy Management. Cannot be used to pay for season subscription. Prize will also include access to the Margaret & Turner Branch Benefactors Lounge for all shows (up to two people per show). The prize is not transferable.
By receipt of any prize, winner agrees to release and hold harmless Popejoy Hall (UNM Public Events), the University of New Mexico, and their respective parent, Board, Regents, subsidiary, and affiliate companies, supplies, distributors, and advertising/promotion agencies, as well as each such companies officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Raffle or receipt, use, or misuse of any prize.
Except where prohibited, participation in the Raffle constitutes winner’s consent to Administrator’s and its agents use of winner’s name, likeness, photograph, voice, opinion, and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
Administrator reserves the right to cancel, suspend and/or modify the Raffle, or any part of it, if any fraud, or other factor beyond the Administrator’s reasonable control impairs the integrity or proper functioning of the Raffle, as determined by Administrator in its sole discretion. In such event, Administrator reserves the right to award the prize at random from among eligible entries received up to the time of the impairment. Administrator reserves the right, in its sole discretion to disqualify any individual, without compensation, it finds to be tampering with the entry process or the operation of the Raffle or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Raffle may be a violation of criminal and civil law, and, should such an attempt be made, Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
All necessary travel documents, such as a Passport or Visa, are the sole responsibility of the winner. Once travel, hospitality, and entertainment arrangements have been secured they are non-refundable and non-exchangeable.
Payment of all federal, state, and local taxes is the sole responsibility of the winner. Winner will be required to sign an IRS Form W-9 or the equivalent to claim the prize.
LIMITATIONS OF LIABILITY
The Released Parties are not liable for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Raffle; (2) unauthorized human intervention in any part of the entry process of the Raffle; (3) technical or human error which may occur in the administration of the Raffle or the processing of entries; or (4) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Raffle or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Raffle.
Except where prohibited, entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Raffle or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a state or federal court located in Albuquerque, New Mexico; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Raffle, but in no event attorney’s fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant claims all rights to claim, indirect, punitive, incidental, and consequential damages and any other damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Administrator in connection with the Raffle, shall be governed by, and construed in accordance with, the laws of the State of New Mexico, without giving effect to any choice of law or conflict of law rules (whether of the State of New Mexico or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New Mexico.
